This ministry operates exclusively in the private domain — not public. We exercise our unalienable right to freedom of association, as protected under the First and Fourteenth Amendments (U.S. Constitution, Section 1) and equivalent state provisions.

All activities, relationships, and governance fall under private religious covenant — not public jurisdiction

Jurisdiction & Status: Private, Non-Corporate, Non-501(c)(3) Ministry

Freedom of religion, press, and speech permits retention of prior text/images pending updates at God's timing. Intention is the sole of this instrument — private ministry, private jurisdiction, outside for-profit corporate commerce.

Changes may be ongoing, nunc pro tunc (now for then), as God's grace permits.

3. Indemnification & Release

Indemnification: You agree to indemnify, defend, and hold harmless the Ministry, Tim Mainka, Sonic Freedom s.s.m., its directors, members, officers, and third-party providers from all losses, expenses, damages, and costs — including reasonable attorneys' fees — arising from:

• Your violation of this Agreement.
• Your negligence or wrongful conduct.
• Unauthorized access to the Service by you or others you permit.
• Acts of God or unforeseen disasters affecting the Site's operations.

Release of Claims: You agree not to initiate legal action against Tim Mainka, Sonic Freedom s.s.m., assignees or successors. You must first attempt private resolution as outlined in Dispute Resolution section.

Covenant Not to Sue: You agree not to pursue litigation against Tim Mainka or the Ministry as covenant for to receive service, accepting any potential private dispute resolution process as outlined in this Agreement.

Dispute Resolution: Any potential disputes shall first be addressed through private, good-faith discussion guided by Christ's teaching within Matthew 18:15–17.

4. Third Party Rights.

The provisions in Sections 2 (Use of the Service) and 3 (Indemnification) benefit Sonic Freedom s.s.m., its officers, directors, members, third-party contractors, and information providers. Each of these parties has the right to assert and enforce these provisions directly against you.

5. Term & Termination.

Acceptance of Terms: By using this Site, you agree to be bound by these Terms of Service. You acknowledge that these Terms may be updated from time to time, and you are responsible for reviewing them periodically.

6. Songwriting Co-writing Agreement: If participating in cowriting of songs, the following is our standard agreement: Music contributions are valued at 50% of the work; lyrical contributions are valued at 50%. Each contributor's share is determined by:

• Lyrics: Percentage of total words contributed.
• Music: Percentage of melody, harmony, and musical sections contributed.

Original concept does not entitle additional ownership percentage.

Creative Control: The primary songwriter, Tim Mainka, has final approval authority over the song's final version, unless all co-writers agree otherwise in writing.

Copyright Ownership: Unless otherwise agreed in writing, all co-writers retain private joint ownership of the copyright in perpetuity. Copyright may be assigned to heirs and successors. Absent written agreement, the copyright remains in private joint ownership and is not subject to public domain ownership transfer without unanimous consent. Registration with the U.S. Library of Congress for eventual public domain ownership status may only happen if all co-writers consent in writing. The private ownership is in perpetuity, unless agreed in writing to register copyright into the public domain (US Library of Congress) for eventual public domain ownership after statutory terms. Absent written agreement by all owners, the copyright should never be owned by the public, but remain in private ownership assignable to heirs and successors, in perpetuity.

7. Important Miscellaneous Stipulations

Relationship: No employer-employee relationship exists between the Ministry and Site Users. Site Users agree that any names or identifiers submitted are for private identification purposes only — not to represent any corporate entity or artificial legal person.

Jurisdictional Boundary Reminder:

Waiver of Punitive Damages: You agree not to seek punitive or exemplary damages against the Ministry or its affiliates in any dispute arising from this Agreement.

Personal Responsibility: You are solely responsible for your actions, decisions, and responses — including legal or emotional outcomes — regardless of any guidance or materials provided.

8. DISPUTE RESOLUTION & GOVERNING LAW

No Conflict of Interest: The Site User warrants that it has no existing agreement, relationship, or commitment to any other person or entity that conflicts with its obligations under this Agreement or the Ministry’s obligations to it.

Dispute Resolution: The parties agree to first attempt to resolve disputes informally through direct discussion with the Ministry’s founder or relevant representative. If unresolved, the parties may pursue private, good-faith mediation guided by Jesus Christ's teachings from Matthew 18:15–17.If you do not agree, then do not continue to use Site or services as we intend to only follow Jesus Christ's teachings for resolution of disputes.

CONFLICT RESOLUTION BY BIBLICAL MEDIATION (Matthew 18:15–17)

By using this Site, you agree that all disputes — including claims of wrongful acts or omissions by Tim Mainka (private man, not an ens legis legal fiction), Sonic Freedom s.s.m., or assignees — shall be resolved exclusively through private, neutral mediation guided by:

Matthew 18:15–17 — Christ’s method for reconciliation within the Body.
1 Corinthians 6:4 — “If you have judgments of this life, set them to judge who are least esteemed in the church.”
The “least esteemed” here are the disabled and financially poor followers of Jesus Christ — chosen as mediators to reflect humility and grace.

Key Terms:

• No Statutory Courts: Legal fiction corporations and statutory courts lack common law or Article III jurisdiction over this covenant. They are not recognized for private dispute resolution.
• One Mediation Required: First mediation is mandatory. A second may be requested only if both parties agree and new, documented evidence exists.
• Third Mediation: Allowed only for bona fide fraud — proven on its face.
• Refusal to Mediate: If either party declines or acts in bad faith, Sonic Freedom s.s.m. may peacefully terminate the relationship — without recourse, obligation, or prejudice.
• Disagreement with Scripture: If you later reject Christ’s method of conflict resolution, you agree Sonic Freedom s.s.m. may separate fully, with no further duty to you.

Further Assurances: Each party agrees, at its own expense, to execute any additional documents or take reasonable actions necessary to fulfill the intent and purpose of this Agreement.

Enforceability: This Agreement is binding on and enforceable by the parties, their successors, assigns, and legal representatives, in accordance with its terms.

Assignment: Neither party may assign this Agreement without the other’s prior written consent — except that the Ministry may assign its rights and delegate its duties to a successor entity (via sale, merger, reorganization, or liquidation) if that successor continues the Ministry’s operations substantially as they exist at the time of transfer.

Modifications of Agreement: Ministry may amend this Agreement at any time. Site Users agree to review it periodically. No correspondence, form, or document from either party shall modify or supplement this Agreement unless expressly stated in writing and signed by Ministry authority.

Headings: Section headings are for reference only and do not affect the interpretation, scope, or enforceability of any provision or the rights and obligations of the parties.

Severability: If any provision of this Agreement is held by a mediator, arbitrator, common law court of record to be illegal, unenforceable, or invalid — in whole or in part — the remaining provisions (or the unaffected portions thereof) shall remain in full force and effect.

PROTECTION OF LAW: Protection of Rights:
The Ministry and Site User enter into this Agreement voluntarily, with the protections of Wisconsin state and the U.S.A. Constitutions, including the right to contract freely and the right to religious liberty. This Agreement is a private contract and is not subject to federal or state regulatory control. Any attempt by government officials to interfere with the lawful performance of obligations and duties under this Agreement may be subject to legal recourse under applicable civil rights statutes, including 42 U.S.C. § 1983, if such interference constitutes a violation of rights. All parties agree that this Agreement shall be interpreted in accordance with the principles of contract law and religious liberty as guaranteed and secured by federal and state constitutions, and that no party shall be held liable for acts performed in good faith under its terms.

AGREEMENT RATIFICATION: Governing Law and Jurisdiction:
This Agreement shall be governed by and construed in accordance with private ecclesiatical jurisdiction of the religious ministry under God in harmony with the law of the land of Wisconsin state -- body politic of people, not any legal fiction CORPORATION STATE, i.e., STATE OF WISCONSIN or UNITED STATES corp. Any dispute arising out of or related to this Agreement shall be resolved in accord with Holy Bible, Matthew 8:15-17 or, at the discretion of the Ministry, in a common law court of record for Wisconsin state (non statutory, non corporate).

The parties acknowledge that this Agreement is not subject to the jurisdiction of any for-profit corporate entity, including the United States corp. or the State of Wisconsin corporate entity. The Ministry and its creator retain all inherent rights under common law and natural law, including religious freedom and liberty, as protected by the U.S.A. Constitution and the Constitution of the Wisconsin state.

This Agreement constitutes the entire understanding between the parties and may only be modified in writing, signed by both parties.

ENTIRE AGREEMENT: This Agreement contains the entire understanding between the parties regarding the release of Tim Mainka. (a private Wisconsinte man acting in private capacity as state of the Union Citizen) and Sonic Freedom s.s.m. or assignees. It supersedes all prior or contemporaneous agreements, whether oral or written. No party is relying on any representation or warranty not expressly stated herein.

BINDING: You hereby expressly recognize that this Agreement is binding. You hereby waive and release all claims, known or unknown, against the indemnified parties arising from your participation with Sonic Freedom s.s.m., use of the Site, products, services, or educational assistance — including claims arising from their negligence.

You have carefully read this agreement and understand its contents. You certify that you are 18 years of age or older, and accept this agreement of your own free will. If you are a minor, request your mother, father or parents permission to use Site. All gifts or benefits received for services or other products are final and non-refundable.

You retain all rights not expressly waived or transferred under this Agreement.
